1. Acceptance of Terms

By accessing or using the HBDcard service, website, or mobile application (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

HBDcard reserves the right to update or modify these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Eligibility

To use HBDcard, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be a resident of a country subject to international sanctions
• Successfully complete our identity verification (KYC) process
• Provide accurate, current, and complete information during registration

3. The HBDcard Service

HBDcard provides a prepaid Mastercard that is funded exclusively by USDT or USDC stablecoin deposits. The card can be used for purchases at any merchant that accepts Mastercard worldwide.

We offer two card types:

• Virtual Card — issued instantly upon approval, suitable for online purchases and digital wallets
• Physical Card — delivered within 5–7 business days, suitable for in-store purchases and ATM withdrawals

HBDcard is a prepaid card service and does not constitute a bank account, credit facility, or investment service.

4. Deposits and Top-ups

Card top-ups are accepted exclusively in USDT or USDC via supported blockchain networks (Ethereum ERC-20, Tron TRC-20). You are solely responsible for sending funds to the correct deposit address and selecting the correct network.

HBDcard is not liable for funds sent to incorrect addresses or via unsupported networks. Deposits are credited following on-chain confirmation.

5. Fees

By using the Service, you agree to the fee schedule published on our website, which includes but is not limited to:

• Monthly Card Fee: $4.95
• Monthly Account Fee: $1.00
• Foreign Exchange Fee: 1.5% on non-USD transactions
• ATM International Withdrawal: $4.00
• Account Redemption Fee: $15.00

HBDcard reserves the right to modify fees with 30 days prior notice.

6. Prohibited Uses

You agree not to use HBDcard for:

• Any unlawful purpose or in violation of applicable laws and regulations
• Money laundering, terrorist financing, or other financial crimes
• Purchasing illegal goods or services
• Gambling or gaming activities where prohibited by law
• Any activity that may cause harm to HBDcard or third parties

Violation of these restrictions may result in immediate account suspension and reporting to relevant authorities.

7. Identity Verification (KYC/AML)

In accordance with applicable anti-money laundering (AML) and know-your-customer (KYC) regulations, we are required to verify your identity before issuing a card. You agree to provide accurate identification documents and consent to our verification process.

We reserve the right to refuse service or suspend accounts that fail to meet our compliance requirements.

8. Account Suspension and Termination

HBDcard may suspend or terminate your account at any time, with or without notice, if we suspect:

• Fraudulent or suspicious activity
• Violation of these Terms and Conditions
• Failure to complete or maintain KYC verification
• Breach of applicable laws or regulations

Upon termination, any remaining balance may be subject to the Account Redemption Fee of $15.00.

9. Limitation of Liability

To the maximum extent permitted by law, HBDcard shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of funds due to market fluctuations, blockchain network failures, or unauthorized account access resulting from your failure to secure your credentials.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with applicable laws. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts.
